Office of the Director of the Mandatory Health care Insurance Fund

The Mandatory Health Insurance Fund (MHIF) is a public health insurance institution with the status of a legal entity, possessing rights, obligations, responsibilities, and special authorizations for the implementation of this Law on behalf of insured persons, including the effective collection of financial resources for the provision of healthcare services by healthcare institutions of all forms of ownership.

The fundamental legal act of the Fund is its Statute, which is approved by the Government.

The Statute of the Fund defines its organization, rights, duties, responsibilities, and the manner in which it performs its activities in accordance with this Law.

Organization and Management of the Fund

The Fund is a public institution of special interest, with the legal autonomy of a juridical person and with specific rights, obligations, responsibilities, and authorizations for the implementation of this Law.

The Fund is authorized to determine the rights and obligations of insured persons regarding mandatory health insurance, as well as to establish the List of Basic Health Care Services.

Employees of the Fund are not part of the Kosovo Civil Service, and their status is regulated by a sub-legal act proposed by the Governing Board and approved by the Government.

The Fund is subject to the legislation and financial management rules applicable to the public sector.

The organization of the Fund’s administrative service is determined by its internal normative acts.

Office of the Director of the Fund

The Director of the Fund is responsible for the work and operations of the Mandatory Health Insurance Fund and shall:

• Represent the Fund;
• Prepare regular and ad hoc reports for the Governing Board;
• Ensure the efficient and effective implementation of risk management and internal control mechanisms;
• Request, at least every five (5) years, an Actuarial Analysis and submit it to the Governing Board;
• Propose members of the Technical Committees for approval by the Governing Board.

Additional rights and responsibilities of the Director shall be defined by the Statute of the Fund.

The duties and responsibilities of the Director of the Mandatory Health Insurance Fund are defined by Law No. 04/L-125 on Health, Law No. 10/L-028 on Mandatory Health Insurance, and other applicable legislation in force.

The duties and responsibilities of the support staff of the Director’s Office are defined by the applicable legislation in force.
